1. Acceptance
By creating a Halvy account, installing the Halvy iOS application, or otherwise using the service (together, the "Service"), you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not accept these terms, do not create an account and uninstall the application.
These terms form a binding agreement between you and Halvy. They will be supplemented, where applicable, by in-app notices, feature-specific disclosures, and any additional agreement you enter into with us in writing.
2. Eligibility
You must be at least 16 years old to use Halvy if you reside in the European Union or the United Kingdom, and at least 13 years old if you reside in the United States, consistent with COPPA. You must also be legally capable of entering into a binding contract under the laws of your country of residence.
You represent that the information you provide at signup is accurate and that you are not barred from using the Service under the laws of any jurisdiction that applies to you.
3. Account and household
A Halvy account is tied to a single email address and is used to join or create a household. A household represents the shared finances of two partners. You may be a member of one household at a time. You are responsible for the security of your account credentials and for any activity that takes place under your account. Notify us immediately at security@halvy.app if you suspect unauthorised access.
Invitations to a household are sent as one-time codes that expire after 48 hours and can only be redeemed once. Once both partners are joined, the household owner cannot unilaterally remove the other partner from co-owned records — see §10 and the "Partner data and shared records" section of the Privacy Policy.
4. Acceptable use
You agree to use Halvy only for its intended purpose: tracking your own shared household finances. You agree not to use the Service to store or share unlawful content; to impersonate another person; to harass your partner or any member of our team; to reverse-engineer, disassemble, or probe the Service for vulnerabilities outside a coordinated disclosure programme; to interfere with sync or notification systems through automated abuse; or to resell access to the Service.
We reserve the right to suspend or terminate accounts that breach this section, with notice where reasonable and without notice where urgent action is required to protect the Service or other users.
5. Intellectual property
The Halvy name, logo, design system, source code, and all text, graphics, and interface elements of the Service are the property of Halvy or its licensors and are protected by copyright, trademark, and other applicable laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service as permitted by these terms and by the App Store terms of use.
You retain ownership of the content you create inside the Service (your expense entries, your goals, your receipts). You grant us a limited licence to store, process, encrypt, and display that content solely to deliver the Service to you and your household partner.
6. Subscription and pricing
During Halvy's v1 beta period, the Service is free of charge. We reserve the right to introduce a paid tier for optional features in the future. If and when we do, we will give account holders clear advance notice — never less than 30 days — describing which features remain free and which require a subscription, and you will always be able to continue using the free tier for the core feature set that was available to you before the pricing change.
Paid subscriptions, when introduced, will be billed through the App Store in accordance with Apple's billing rules. Cancellations, refunds, and auto-renewal management follow Apple's standard terms.
7. Third-party services
The Service depends on third-party services to operate: Apple's App Store for distribution, APNs for push notifications, Fly.io for hosting, and Cloudflare for edge delivery. We do not control these services and we are not responsible for their availability or their own terms. Your use of the Service is subject, in addition, to any terms those providers impose directly on end users.
A current list of sub-processors is maintained in our Privacy Policy.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data you store will never be lost or corrupted, and we strongly recommend that you use the export feature to keep your own backups of critical records.
Nothing in this section limits any warranty or statutory right that cannot be excluded under the law of your country of residence — notably, consumer rights under EU and UK law remain fully in force.
9. Liability cap
To the extent permitted by applicable law, our aggregate liability arising out of or related to the Service — whether in contract, tort, statute, or otherwise — is limited, per account, to the greater of the amounts you have paid us in the twelve months preceding the event giving rise to the claim, and one hundred euros (EUR 100). We are not liable for indirect, incidental, consequential, or special damages, or for loss of profit, revenue, data, or goodwill.
This cap does not apply to liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or injury to life or body.
10. Termination
You may terminate your Halvy account at any time from Settings → Delete account. On termination, your personal profile data is deleted and your attribution on co-owned household records is anonymized, as described in the Privacy Policy. Your household partner continues to have access to the shared records they co-own.
We may terminate or suspend your account if you materially breach these terms, if your account is dormant for an extended period and we have given notice, or if we cease providing the Service. Where reasonable, we will give you 30 days' notice and an opportunity to export your data before closure.
11. Dispute resolution and governing law
The governing law and the competent courts for any dispute arising out of these terms will be specified before Halvy's public launch, and will align with the location of our registered legal entity. This draft does not waive any mandatory consumer protection rules of the country where you reside, which always remain available to you regardless of the governing law we select.
Before bringing any dispute, we ask you to contact us at support@halvy.app so we can try to resolve the matter informally. If informal resolution is not possible, consumers in the EU may also use the European Commission's online dispute resolution platform.
12. Severability, entire agreement, and contact
If any provision of these terms is found unenforceable by a competent authority, the remaining provisions continue in full force, and the unenforceable provision is replaced by an enforceable one that most closely matches the intent of the original. These terms, together with our Privacy Policy and any written agreement we sign with you, constitute the entire agreement between you and Halvy regarding the Service and supersede any prior understandings.
